Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Punchup event link generator tool at punchupshows.live (the "Service"), operated by Punchup ("we," "our," or "us").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

Description of Service

The Service is a free, public tool that allows users to generate promotional links for comedy shows and events. Users can select venues, date ranges, and specific events to create shareable landing pages that display event information and ticket purchasing links.

The Service aggregates publicly available event data from Punchup's event database and presents it in a user-friendly format for promotional purposes.

Permitted Use

You may use the Service for lawful purposes only. Specifically, you may:

  • Generate promotional links for comedy shows and events
  • Share generated links on social media, email campaigns, and advertising platforms
  • Use the Service without creating an account or providing personal information

Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of any local, state, national, or international law
  • Attempt to gain unauthorized access to the Service, other users' accounts, or computer systems or networks
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Use automated scripts, bots, or other means to access the Service in a manner that sends more requests than a human can reasonably produce
  • Misrepresent your affiliation with any venue, comedian, or event
  • Use the Service to distribute spam, malware, or other harmful content
  • Scrape, copy, or duplicate event data for commercial purposes without authorization

Event Information Accuracy

The Service displays event information obtained from third-party sources and Punchup's event database. While we strive to provide accurate and up-to-date information, we do not guarantee the accuracy, completeness, or timeliness of event details, including dates, times, venues, pricing, or availability.

Users should verify event information directly with the venue or ticketing platform before making purchasing decisions or promoting events. We are not responsible for any errors, omissions, or changes to event information.

Third-Party Services

The Service contains links to third-party ticketing platforms and websites. These third-party services are not under our control, and we are not responsible for their content, privacy policies, or practices. Your use of third-party services is at your own risk and subject to their respective terms and conditions.

We do not process ticket sales or handle payment transactions. All ticket purchases are conducted through third-party ticketing platforms.

Intellectual Property

The Service and its original content, features, and functionality are owned by Punchup and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Event information, images, and descriptions displayed on the Service may be owned by third parties, including venues, comedians, promoters, and ticketing platforms. Use of such content is subject to the rights of the respective owners.

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected. We make no warranties about the accuracy or reliability of any information obtained through the Service.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PUNCHUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or other harmful code that may be transmitted through the Service
  • Any errors or omissions in event information or content
  • Any loss or damage incurred as a result of your reliance on event information provided through the Service

Indemnification

You agree to indemnify, defend, and hold harmless Punchup and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another party.

Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last Updated" date at the top of these Terms. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in the United States.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
